What are trademark filing fees?
The fees that the United States Patent and Trademark Office (“USPTO”) charges you for filing your trademark application depends on the type of application you’re filing. These are the most common:
Number of classes: Your trademark application must specify what “class” of goods or services you want to (or will) use your mark in. Are you going to use your mark to sell t-shirts or real estate? You must decide on this before you file. The USPTO charges a filing fee for each class, depending on whether you file a TEAS Plus or TEAS Standard application (see below).
TEAS Plus vs. TEAS Standard applications: A TEAS Plus application ($250 per class) is considered a more complete application, and ends up on the USPTO’s principal register of trademarks. A TEAS Standard application ($350 per class) has less initial requirements but a higher filing fee. Nowadays, most applicants prefer to file a TEAS Plus application.
Intent-to-use applications: You must provide a specimen showing the USPTO how you’re using your mark. If you don’t have a specimen ready for showing at the time you file your trademark application, you must file an “intent-to-use” application which requires an additional $100 fee paid to the USPTO per class. After filing this, if you need more time than allowed to prepare a specimen, the USPTO requires a $125 fee per class for an extension.
